Supreme Court Overturns Drug Conviction
RB was arrested and charged with possession of cocaine after an informant called the police and told them that he was at a restaurant with drugs in his pocket. His trial attorney filed a Motion to Suppress the search, arguing that the police did not conduct any investigation in order to determine if this informant was reliable. The trial court denied the motion, and RB was convicted of possession of cocaine. On appeal, Kara Hoopis Manosh wrote a 12A Statement to the Rhode Island Supreme Court, arguing that the trial court made an error of law when it denied the Motion to Suppress. The Supreme Court agreed and vacated the conviction. RB now has a clear criminal record.
